Contractul de furnizare va fi incheiat, ]n principiu, pe o perioada de 60 de zile. Valoarea estimata totala a contractului va fi 1.779.602 lei fara TVA. Valoarea contractului va fi determinata de fiecare lot de produse, in parte, din cele 19 loturi.

Garantia de participare este de 1% din valoarea estimata a fiecarui lot. Numar zile până la care se pot solicita clarificări înainte de data limită de depunere a ofertelor/candidaturilor: va fi de 18 zile, inainte de data limita de depunere a ofertelor. Autoritatea contractanta va raspunde solicitarilor de clarificari în a a 11-a zi inainte de data limita de depunere a ofertelor. Durata contractului va fi in principiu, pana la 31.12.2021, cu posibilitatea prelungirii prin constituirea acreditivului deschis la Trezorerie. Taxele specifice constituirii acreditivului vor fi suportate de catre ofertantul castigator.

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

1. Operatorii economici nu trebuie sa se regaseasca in situatiile prevazute la art.164,165,167 din Legea 98/2016. Operatorul economic (lider, asociat, tert sustinator, subcontractant) va completa cerinta corespunzatoare in formularul DUAE, conform art.193 alin (1) din Legea 98/2016. Incadrarea in prevederile art.164,165,167 din Legea 98/2016 privind achizitiile publice atrage excluderea ofertantului din procedura aplicata pentru atribuirea contractului de achizitie publica.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre oeratorii economici participanti la procedura de atribuire (inclusiv eventualii terti si subcontractanti) cu informatiile aferente situatiei lor.

Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Aceste documente vor fi:

- Certificat de atestare fiscala (inclusiv privind plata contributiilor sociale) pentru persoane juridice, eliberat de ministerul Finantelor Publice sau unitatile sale subordonate, care au calitatea de creditor bugetar.Se vor prezenta documentele justificative (certificatele fiscale) actualizate prin care demonstreaza indeplinirea criteriilor de calificare in conformitate cu informatiile cuprinse in DUAE, prin care trebuie sa ateste lipsa datoriilor restante la momentul depunerii acestora. Se va prezenta copie „conform cu originalul”

- Certificat privind plata impozitelor si taxelor locale, eliberat de Primarie (Consiliul Local).Se vor prezenta documentele justificative (certificatele fiscale) actualizate prin care demonstreaza indeplinirea criteriilor de calificare in conformitate cu informatiile cuprinse in DUAE, trebuie sa ateste lipsa datoriilor restante la momentul depunerii acestora. Se va prezenta copie „conform cu originalul”

Persoane juridice/fizice straine, documente edificatoare, eliberat de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca indeplinirea obligatiilor restante de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta, valabile la momentul depunerii acestora .

Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.

- Cazier judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutive.

- Dupa caz, documentele prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogari prevazute la art. 166 alin.(2), art 171 din Legea nr. 98/2016 privind achizitiile publice.

- Dupa caz, alte documente edificatoare.

Nota:

Modalitatea prin care poate fi demonstrata indeplinirea cerintelor: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la finalizarea evaluarii ofertelor, doar de catre ofertantul clasat pe primul loc.

2. Declaratie pe propria raspundere privind neincadrarea in prevederile art. 58 din Legea 98/2016 privind achizitiile publice. În cazul asocierii, criteriile de calificare privind situatia personala vor fi îndeplinite de fiecare asociat . Operatorul economic (lider, asociat, tert sustinator, subcontractant) va completa cerinta corespunzatoare in formularul DUAE. Declaratia pe propria raspundere se va depune in SEAP odata cu DUAE.

Modalitatea prin care poate fi demonstrata indeplinirea cerintelor de mai sus: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative sau documentele echivalente emise in in conformitate cu legislatia aplicabila in tara de rezidenta (pentru ofertantii straini) care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, la finalizarea evaluarii ofertelor, doar de catre ofertantul clasat pe primul loc.

Nota:

- Nedepunerea DUAE odata cu oferta (inclusiv pentru asociat/tert sustinator) atrage respingerea acesteia ca inacceptabila.

- Se vor depune, odata cu DUAE, urmatoarele documente : angajamentul ferm al tertului sustinator din care rezulta modul efectiv în care se va materializa sustinerea acestuia, a acordului de subcontractare si/sau a acordului de asociere, dupa caz. Nedepunerea acestora odata cu DUAE, constituie temei pentru solicitarea de clarificari pentru eventualele inadvertente de forma ale informatiilor cuprinse în sectiunile DUAE, atât ale ofertantului/candidatului, cât si ale subcontractantului/tertului sustinator, acest lucru fiind necesar pentru a asigura desfasurarea corespunzatoare a procedurii de atribuire. Nedepunerea DUAE odata cu oferta (inclusiv pentru asociat/tert sustinator) atrage respingerea acesteia ca inacceptabila.

1. Certificat constatator cu anexele vizate la zi, emise de Oficiul National ai Registrului Comertului din care sa rezulte ca :domeniul de activitate al ofertantului corespunde obiectului procedurii. Certificatul se va prezenta în oricare dintre formele: copie legalizata/autentificata, copie lizibila cu mentiunea "conform cu originalul". In cazul unei asocieri documentul trebuie prezentat de fiecare asociat, pentru partea de contract pe care o realizeaza.

2. AAvizul de funcționare pentru activitățile de import și distribuție dispozitive medicale emis de ANMDM in conformitate cu art. 926 din Legea nr. 95/2006 privind reforma în domeniul sănătății,

3. Completare DUAE:documentele justificative care probeaza îndeplinirea cerintelor asumate prin completarea DUAE, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, la finalizarea evaluarii ofertelor, doar de catre ofertantul clasat pe primul loc.
