I. Zamawiający Wykluczył nw. Wykonawcę:

KG Construction Sp. z o.o. 41-800 Zabrze, ul. Pawliczka 25.

1. Uzasadnienie prawne:

Na podstawie art. 24 ust. 1 pkt 12) Ustawy z dnia 29.1.2004 r. Prawo zamówień publicznych Zamawiający wyklucza wykonawcę, który nie wykazał spełnienia warunków udziału w postępowaniu.

2. Uzasadnienie faktyczne:

Na podstawie stwierdzonych braków w wymaganych dokumentach, które Wykonawca był zobowiązany dostarczyć Zamawiającemu na podstawie art. 26 ust. 1 ustawy Prawo zamówień publicznych w celu potwierdzenia braku podstaw do wykluczenia oraz wykazania spełnienia warunków udziału w postępowaniu określonych w Części XI i XII SIWZ. Zamawiający w oparciu o art. 26 ust. 3 ustawy, wezwał powtórnie Wykonawcę do uzupełnienia ww. dokumentów, m.in. o informację z Krajowego Rejestru Karnego w zakresie określonym w art. 24 ust. 1 pkt 13, 14 ustawy z wyłączeniem pkt 13 lit d) oraz informacji z Krajowego Rejestru Karnego w zakresie określonym w art. 24 ust. 1 pkt 21 ustawy, wystawionej dla podmiotu na zasobach którego Wykonawca polega. W odpowiedzi nie dostarczono informacji z KRK dla ustanowionych w firmie prokurentów, a tym samym Wykonawca nie wykazał spełnienia warunków udziału w postępowaniu.

Na podstawie art. 89 ust. 1 pkt 5) ustawy Pzp oferta złożona przez Wykonawcę wykluczonego z postępowania podlega odrzuceniu.

II. Zamawiający unieważnił postępowanie w zakresie zadań nr 2,3,4,7,10,11 i 14. na podstawie art. 93 ust. 1 punkt 4) ustawy Prawo zamówień publicznych, ponieważ cena najkorzystniejszej oferty przewyższa kwotę, którą Zamawiający zamierza przeznaczyć na sfinansowanie zamówienia.
