III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Ofertantii nu trebuie sa se regaseasca în situatiile prevazute la art. 164, 165 si 167 din Legea nr. 98/2016.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele III locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Declaratie pe propia raspundere privind neincadrarea in prevederile art.60 din Legea 98/2016si art. 21 din HG 395/2016. Declaratia privind neincadrarea in prevederile art. 60 din Legea 98/2016 va fi prezentata de toti participantii la procedura impreuna cu DUAE.

Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe lprimele III locuri în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

Documentele justificative, care probeaza îndeplinirea celor asumate prin completarea DUAE la momentul prezentarii:

— certificate constatatoare care atesta lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii,

— cazier judiciar al operatorului economic si al membrilor organului de administrare, de decizie sau de supraveghere al respectivului operator economic sau al celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;

— certificat de inregistrare fiscala eliberat de ORC (CUI);

— certificat constatator elibereat de ONRC in copie legalizata/copie lizibila conform cu originalul. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator;

— dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

— orice alte documente edificatoare (dupa caz);

— declaratie privind neincadrarea in situatiile potential-generatoare de conflict de interese, conform art. 59, 60 din Legea 98/2016.

Persoanele ce detin functii de decizie in cadrul autoritatii contractante in ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire sunt urmatoarele:

Autorizatie/aviz de functionare emis de Ministerul Sanatatii. Actul normativ care impune acest document-art. 926 din Legea 95/2006. Pentru persoane juridice strine, se vor prezenta documentele echivalente, emise in conformitate cu legislatia aplicata in tara de rezidenta. Prezentarea autorizatiilor valabile la data-limita de depunere a ofertelor in copie lizibila cu mentiunea „conform cu originalul”. Documentele redactate in alta limba decat romana vor fi insotite de traducerea autorizata.

Pentru contractele de achizitie de bunuri: esantioane, descrieri sau fotografii, fara certificate de autenticitate. Prezentarea obligatorie pentru toate loturile la sediul autoiritatii contractante de: esantioane, monstre, descrieri sau fotografii ale produselor care urmeaza a fi ofertate pana la data-limita de depunere a ofertei.

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri în clasamentul intermediar, întocmit la finalizarea evaluarii ofertelor.

Justificare pentru alegerea licitatiei deschise accelerate.

Avand in vedere ca obiectul prezentei licitatii il reprezinta echipamente de protectie necesare protectiei personalului angajat al Sanatoriului de Pneumoftiziologie Geoagiu, compexitatea achizitiei este una redusa, motiv pentru care termenul de 15 zile este unul suficient pentru ca operatorii sa-si poata elabora si depune ofertele.
