Justification:

Zamawiający jest zmuszony podjąć pilnie działania zmierzające do wykonania zamówienia publicznego. Konieczne jest skrócenie terminu składania ofert w niniejszym postępowaniu. Czynność ta wynika z konieczności zagwarantowania dostępności środków ochrony indywidualnej (m.in. kombinezony, maski, fartuchy), które w dobie pandemii są towarem strategicznym. Z powodu trwającej pandemii COVID-19 i kolejnej fali wzrostu zakażeń, asortyment został wykorzystany wcześniej niż zakładano w trakcie planowania poprzedniego postępowania przetargowego. Brak zawartych umów na dostawę środków ochrony naraża szpital na niebezpieczeństwo zaprzestania dostaw do szpitala.

Jednocześnie, skrócenie terminu składania ofert w niniejszym postępowaniu o udzielenie zamówienia publicznego nie pozbawia Wykonawców możliwości udziału w tym postępowaniu. Biorąc pod uwagę charakter przedmiotu zamówienia, przygotowanie przez Wykonawców ofert nie jest czasochłonne. Rynek w tym zakresie skupia profesjonalne podmioty.

Zamawiający nie wymaga wniesienia wadium na podstawie art. 15va ustawy z dnia 2 marca 2020 r. o szczególnych rozwiązaniach związanych z zapobieganiem, przeciwdziałaniem i zwalczaniem COVID-19, innych chorób zakaźnych oraz wywołanych nimi sytuacji kryzysowych.

1. Zamawiający informuje, że postępowanie prowadzone jest na zasadach określonych w art. 24aa i zastrzega, iż w pierwszej kolejności dokona oceny ofert, a następnie badać będzie czy Wykonawca, którego oferta została oceniona jako najkorzystniejsza, nie podlega wykluczeniu oraz spełnia warunki udziału w postępowaniu.

2. Do oferty każdy Wykonawca musi dołączyć aktualny na dzień składania ofert jednolity europejski dokument zamówienia – załącznik nr 2 do SIWZ. JEDZ należy złożyć w postaci elektronicznej opatrzonej kwalifikowanym podpisem elektronicznym.

3. W celu potwierdzenia przez Wykonawcę, którego oferta została najwyżej oceniona, braku podstaw wykluczenia, zgodnie z art. 26 ust. 1 ustawy Pzp, Zamawiający wezwie do złożenia następujących oświadczeń i dokumentów aktualnych na dzień ich złożenia:

1) informacji z Krajowego Rejestru Karnego w zakresie określonym w art. 24 ust. 1 pkt 13, 14 i 21 ustawy Pzp, wystawionej nie wcześniej niż 6 miesięcy przed upływem terminu składania ofert;

2) oświadczenie wykonawcy o braku wydania wobec niego prawomocnego wyroku sądu lub ostatecznej decyzji administracyjnej o zaleganiu z uiszczaniem podatków, opłat lub składek na ubezpieczenia społeczne lub zdrowotne albo – w przypadku wydania takiego wyroku lub decyzji – dokumenty potwierdzające dokonanie płatności tych należności wraz z ewentualnymi odsetkami lub grzywnami lub zawarcie wiążącego porozumienia w sprawie spłat tych należności - załącznik nr 6 do SIWZ;

3) oświadczenie wykonawcy o braku orzeczenia wobec niego tytułem środka zapobiegawczego zakazu ubiegania się o zamówienia publiczne - załącznik nr 6 do SIWZ;

W celu potwierdzenia przez wykonawcę, którego oferta została najwyżej oceniona, że dostawy odpowiadają wymaganiom określonym przez Zamawiającego, zgodnie z art. 26 ust. 1 ustawy Pzp, Zamawiający wezwie do złożenia dokumentów potwierdzających spełnienie opisanych wymaganych parametrów oferowanych produktów, tj. w szczególności np. karty techniczne produktu, katalogi
