List and brief description of conditions:

Cerinta nr 1 -Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016 Precizam ca persoanele cu functii de decizie din cadrul entitatii contractante sunt: Ghelasă Viorel DIRECTOR TEHNIC, Manailă Gheorghe DIRECTOR ,Tăbăcaru Ion DIRECTOR ECONOMIC, Ricea Melania ECONOMIST, Dudas Carmen JURIST. Ofertantii , tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art 58-60 din legea 98/2016, repectiv se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, se va depune odata cu DUAE si acordul de subcontractare .Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza sa fie prezentate , la solicitarea A.C.,doar de catre ofertantul pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente justificative pot fi: 1.•Certificate constatatoare privind lipsa datoriilor Restante

cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat(buget local,buget de stat etc.) la momentul prezentarii acestora; 2.• cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; 3.• dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice; 4.• alte documente edificatoare, dupa caz. Pentru persoanele juridice straine: Se vor depune documente echivalente emise in tara de rezidenta.

Cerinta nr. 1 Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate prin care poate fi demonstrata îndeplinirea cerintei: - se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor. Informatiile din certificatul constatator trebuie sa fie REALE/VALIDE la data prezentarii acestuia Operatorii economici ce depun oferta trebuie sa dovedasca o forma de inregistrare in conditiile legii din tara rezidenta , din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna din situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Se va completa DUAE cu informatiile cerute , certificat constatator emis de ONRC sau in cazul ofertantilor straini, documente echivalente emise in tara rezidenta si urmeaza sa fie prezentate , la solicitarea A.C.,doar de catre ofertantul pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.Informatiile din certificatul constatator trebuie sa fie reale/valide la momentul depunerii ofertei si la data solicitarii depunerii documentelor DUAE. Justificare: Cerin?a respecta prevederile art. 173 din Legea nr.98/2016 Solicitarea certificatului constator permite AC sa verifice daca ofertantul are inscris domeniul de activitate solicitat prin documentatia de atribuire si în acelasi timp starea la zi a ofertantului privind urmatoarele informatii: • denumirea (firma); • emblema; • numarul de înregistrare în registrul comertului; • codul unic de înregistrare; • starea firmei; • forma juridica; • sediul social/profesional; • durata de functionare; • obiectul de activitate - domeniul si activitatea principala; • capitalul social (subscris si varsat), numarul si valoarea partilor sociale; • asociatii, datele de identificare, numarul partilor sociale atribuite fiecarui asociat pentru aportul sau, participarea la capitalul social si la profit si pierdere (pentru societatile cu raspundere limitata, în comandita simpla sau în nume colectiv); • Administratorii/Membrii Consiliului de administratie si Directorii (în sistemul unitar)/ Membrii Consiliului de supraveghere si Membrii Directoratului (în sistemul dualist), datele de identificare si durata mandatului cu puterile conferite; • cenzorii/auditorii financiari; • sediile secundare; • activitati si sedii autorizate; • indicatorii din situatiile financiare anuale; • alte mentiuni referitoare la masuri asiguratorii si condamnari penale. SE VOR PREZENTA DOCUMENTELE: • Declaratia DUAE completata separat de fiecare dintre participanti (in calitate de ofertant unic, ofertant asociat, tert sustinator sau subcontractant). Cand va primi o solicitare in acest sens, ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, va prezenta: - Certificatul constatator eliberat de Oficiul Registrului Comertului. Datele prevazute in certificat trebuie sa fie reale /valide la momentul depunerii acestuia. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de ORC. NOTA: In lipsa inregistrarii la ORC (persoane fizice romane, persoane fizice /juridice straine), sunt acceptate documente echivalente care sa dovedeasca o forma de inregistrare/atestare/apartenenta profesionala adecvate in raport cu obiectul contractului.

Loturile: 1,10,11,2,3,4,5,6,7,8,9Pentru contractele de achizitie de bunuri: esantioane, descrieri sau fotografii, fara certificate de autenticitateOperatorul economic are obligația de a depune la sediul DIRECȚIEI SILVICE BACAU din Comuna Hemius Sat Lilieci Parc Dendrologic Hemeius, Judetul Bacau , mostre/esantioane pentru fiecare produs ofertat , până la data și ora limită de depunere a ofertelor. Ofertele depuse fără a prezenta mostre la sediul autorității contractante, în termenul precizat, vor fi respinse. De asemenea mostrele depuse după data și ora limită de depunere a ofertelor în SICAP nu vor fi luate în considerare. Mostrele/esantioanle vor fi verificate in ceea ce priveste confortul, calitatea si aspectul acestora de comisia de evaluare a Directiei Silvice Bacau.

Modalitatea de îndeplinire:Se va completa DUAE (conform art. 193, alin. (1) din Legea nr. 98/2016) și se va prezenta câte o mostră/esntion impreuna cu declaratiile de calitate si conformitate pentru fiecare produs solicitat de autoritatea contractantă pana la data limita de depunere a ofertelor. Mostrele/esantioanele prezentate de catre ofertantul castigator se vor pastra ca etalon al calității articolelor ce urmează a fi livrate, iar cele prezentate de catre ofertantii declarati necastigatori se vor restitui in termen de 5 zile calendaristice de la data incheierea contractului cu ofertantul declarat castigator. Orice abatere ulterioara de la mostra etalon va duce la respingerea respectivului produs.
