List and brief description of conditions:

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.60 (completare Formular 6), art.164, art.165, art.167 din Legea nr.98/2016.

Modalitatea prin care poate fi demonstrata indeplinirea cerintei: SE VA COMPLETA DUAE de catre operatorii economici participanti (inclusiv eventualii terti si subcontractanti) la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea Autoritatii contractante, doar de catre ofertantii situati pe primele 3 locuri in clasamentul intermediar. Aceste documente pot fi:

1. Certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (bugetul local, bugetul de stat) - valabile la momentul prezentarii; pentru posibilii ofertanti straini - documente edificatoare, eliberate de autoritatile din tara in care acestia sunt rezidenti, valabile la momentul prezentarii;

2. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul contatator emis de ONRC/actul constitutiv;

3. Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2),art. 167 alin. (2), art. 171 din Legea nr. 98/2016 privind achizitiile publice;

4. Alte documente edificatoare, dupa caz.

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.60 din Legea 98/2016. Se va prezenta Declaratia odata cu DUAE.

Lista cu persoanele ce detin functii de decizie: ec.Doina Caba – manager; ec.Iulia-Geanina Ungureanu – director financiar-contabil; dr.Constantin Laurian Radu – director medical; ec.Lucian Buchir – sef Serviciu Achizitii; jr.Dorel Hutanu – sef Serviciu juridic; jr.Georgiana Bucsa – jurist, viza CFP; ec. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatiile care fac obiectul contractului, respectiv detin:

- Certificatul constatator emis de ONRC sau pentru ofertantii straini documente echivalente emise in tara de rezidenta.

- Autorizatie de distributie angro sau autorizatia de functionare eliberata de Ministerul Sanatatii, in conformitate cu dispozitiile art.800 din Legea nr. 95/2006 privind reforma in domeniul sanatatii, cu modificarile si completarile ulterioare, Titlul XVII- Medicamentul si ale art.2 din normele la Ordinul nr.131/2016 pentru aprobarea Normelor privind infiintarea, organizarea si functionarea unitatilor de distributie angro de medicamente de uz uman: „pentru a putea distribui angro medicamente, solicitatntii trebuie sa detina o autorizatie de distributie angro emisa in SEE” (SEE = Spatiul Economic European). Operatorii economici trebuie sa prezinte, la cererea autoritatii contractante, copie dupa Certificatul de buna practica de distributie angro in perioada de valabilitate (art.23, Normele de aplicare a ordinului nr.131/2016). Orice suspendare a autorizatiei de distributie angro se anunta achizitorului in situatia in care exista contracte subsecvente valabile perioadei aferente. Pentru operatorii straini se vor depune documente echivalente emise in tara rezidenta. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea Autoritatii contractante, doar de catre ofertantii situati pe primele 3 locuri in clasamentul intermediar.

Analiza documentelor prezentate de ofertanti de catre comisia de evaluare nu angajeaza din partea acesteia nicio raspundere sau obligatie fata de acceptarea ca fiind autentice sau legale si nu inlatura raspunderea exclusiva a ofertantului sub acest aspect. Orice operator economic înregistrat în SICAP are dreptul de a transmite oferta. Atât elementele propunerii tehnice specifice produselor cât si elementele propunerii financiare sunt transmise în SICAP de catre operatorul economic. Oferta va fi depusa în SICAP. Nu se accepta oferte alternative. Neprezentarea propunerii tehnice sau/si financiare are ca efect descalificarea ofertantului Se vor respinge ofertele care au fost depuse dupa data si ora limita de depunere sau la o alta adresa decât SICAP. Autoritatea contractanta mentioneaza ca va incheia acordul cadru cu toti operatorii economici clasati pe locurile aferente numarului maxim de operatori economici, respectiv 3, mentionat in fisa de date si in anuntul de participare. In cazul in care in urma aplicarii criteriului de atribuire ”pretul cel mai scazut", sunt doua sau mai multe oferte cu acelasi pret, departajarea se va realiza prin transmiterea online a unei solicitari de reofertare din partea autoritatii contractante, la care, ofertantii vor transmite raspunsul lor online (in SICAP) semnat cu semnatura electronica extinsa. In cazul in care se constata ca ofertele clasate pe acelasi loc, autoritatea contractanta va solicita reofertarea, in vederea departajarii ofertelor. Ofertele vor fi depuse pana la un termen limita clar stabilit de autoritatea contractanta in SICAP. Autoritatea contractanta isi rezerva dreptul de a rezilia unilateral acodul cadru inainte de termen in cazul in care Ministerul Sanatatii va incheia in baza OUG 71/2012 acorduri cadru avand ca obiect produsele din prezenta procedura. Incetarea acordului cadru se va face si in urmatoarele cazuri: - prin achiziția cantităților maxime de produse prevăzute în prezentul acord-cadru, anterior ajungerii la termen; - prin eliminarea produsului/produselor din lista medicamentelor incluse in CANAMED. In acest sens se va transmite o informare catre semnatarii acordului-cadru în termen de 5 zile; - prin rezilierea de către o parte ca urmare a neîndeplinirii sau îndeplinirii în mod necorespunzător a obligaţiilor asumate prin prezentul acord – cadru, de către cealaltă parte, cu notificare prealabilă de 5 zile a părţii în culpă.

Orice solicitare de clarificari referitoare la prezenta documentatie de atribuire si pe tot parcursul derularii procedurii, se vor adresa în mod exclusiv în SICAP la sectiunea "Întrebari" din cadrul procedurii de atribuire derulata prin mijloace electronice, iar raspunsurile la acestea vor fi publicate în SICAP la sectiunea "Documentatie si clarificari" din cadrul anuntului de participare semnate cu semnatura electronica extinsa, autoritatea contractanta urmând sa nu dea curs solicitarilor adresate prin alta modalitate de comunicare decât cea stabilita. Toate documentele se vor depune in SICAP. semnate cu semnatura electronica extinsa, conform art.60, alin.(4) din HG nr.395/2016, pentru fiecare lot in parte la care se depune oferta.

Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.
