List and brief description of conditions:

Gospodarski subjekt mora dokazati: upis u sudski, obrtni, strukovni ili drugi odgovarajući registar u državi njegovog poslovnog nastana.

Za potrebe utvrđivanja okolnosti iz ove točke dostavlja se ispunjeni ESPD obrazac - Dio IV. Kriteriji za odabir, Odjeljak A: Sposobnost za obavljanje profesionalne djelatnosti: točka 1.) za ponuditelja/člana zajednice gospodarskih subjekata.

Naručitelj će prije donošenja odluke o odabiru od ponuditelja koji je podnio ekonomski najpovoljniju ponudu zatražiti da dostavi ažurirane popratne dokumente - odgovarajući izvadak iz sudskog, obrtnog, strukovnog ili drugog odgovarajućeg registra koji se vodi u državi članici poslovnog nastana gospodarskog subjekta kojim gospodarski subjekt mora dokazati upis u sudski, obrtni, strukovni ili drugi odgovarajući registar u državi njegova poslovnog nastana.

a) Procijenjena vrijednost predmetne nabave za sve grupe nadmetanja ukupno iznosi 459.400,00 kn (bez PDV-a), odnosno po grupama, kako slijedi:

Pravo na žalbu ima svaki gospodarski subjekt koji ima ili je imao pravni interes za dobivanje određenog ugovora o javnoj nabavi i koji je pretrpio ili bi mogao pretrpjeti štetu od navodnoga kršenja subjektivnih prava.

Pravo na žalbu ima i središnje tijelo državne uprave nadležno za politiku javne nabave i nadležno državno odvjetništvo.

Žalba se izjavljuje Državnoj komisiji za kontrolu postupaka javne nabave, Koturaška cesta 43/IV, 10000 Zagreb (www.dkom.hr)

Žalba se izjavljuje u pisanom obliku, te se dostavlja neposredno, putem ovlaštenog davatelja poštanskih usluga ili elektroničkim sredstvima komunikacije putem međusobno povezanih informacijskih sustava Državne komisije i EOJN RH (putem sustava e-Žalba).

Žalitelj je obvezan primjerak žalbe dostaviti naručitelju u roku za žalbu na dokaziv način.

Žalba se izjavljuje u skladu s člankom 405. i u roku sukladno članku 406. ZJN 2016.

Žalba se izjavljuje u roku deset (10) dana, i to od dana:

1. objave poziva na nadmetanje, u odnosu na sadržaj poziva ili dokumentacije o nabavi,

2. objave obavijesti o ispravku, u odnosu na sadržaj ispravka,

3. objave izmjene dokumentacije o nabavi, u odnosu na sadržaj izmjene dokumentacije,

4. otvaranja ponuda u odnosu na propuštanje naručitelja da valjano odgovori na pravodobno dostavljen zahtjev dodatne informacije, objašnjenja ili izmjene dokumentacije o nabavi te na postupak otvaranja ponuda

5. primitka odluke o odabiru ili poništenju, u odnosu na postupak pregleda, ocjene i odabira ponuda, ili razloge poništenja.

Žalitelj koji je propustio izjaviti žalbu u određenoj fazi otvorenog postupka javne nabave sukladno gore navedenim opcijama nema pravo na žalbu u kasnijoj fazi postupka za prethodnu fazu. Žalba mora sadržavati najmanje podatke i dokaze navedene u članku 420. ZJN 2016.
