DescriptionThis notice is to inform interested insurance-companies that the Swedish and Danish Air Navigation Service Providers LFV (Sweden) and Naviair (Denmark) renews a Qualification System for the prequalification and registration of insurance companies for the purpose of awarding contracts for common Aviation Liability Insurance. The insurance cover required is protection against LFV and Naviair and their associated and subsidiary companies' legal liability arising from the provision of Air Navigation Services and therewith associated activities. The Qualification System covers insurance companies who offers support behind a Leading Insurer.

Additional informationAn application form (declaration of compliance) and an ESPD (European single procurement document) regarding the exclusion criteria etc. must be used by new applicants for the position of support behind a leading insurer when applying for the Qualification System. Insurance-companies already qualified shall not apply again unless company-information has changed. The Qualification System will be the first stage of qualification and will either be used as the basis for tender selection or may be supplemented by additional qualification criteria established by Naviair and LFV. When a tender procedure has started WTW will call for tenders among the prequalified insurance companies.

5.1.10.
Award criteria
Description of the method to be used if weighting cannot be expressed by criteriaThe procedure is described in the tender material. Prequalification of interested applicants will be handled/administered by the insurance broker Willis Towers Watson on behalf of LFV and Naviair. The Qualification System is an on-going system and is established in order to prequalify additional insurance companies for the list of potential tenderers. Insurance companies may apply to be included in the Qualification System at any time during its existence and the applications will be evaluated continuously. However, in order to participate in the upcoming tender procedure in May 2024, the Deadline for application is 2 April 2024.

Information about review deadlines: As a consequence of Danish Act No 593 of 2.6.2016 on the enforcement of procurement rules, etc. there are following deadlines for lodging appeals in Denmark: Complaints about not being pre-qualified shall be submitted to ‘Klagenævnet for Udbud’ (Board of Appeal) within 20 calendar days from the day following the day on which the contracting entity has sent a notification with an explanation of the decision to interested applicants who have been prequalified. In other situations, the complaint against the tender or the decision must be submitted to ‘Klagenævnet for Udbud’ before: 1) 45 days after the contracting entity has published a notice in the Official Journal stating that the contracting entity has entered into a contract. The period is calculated from the day following the day on which notice has been published. 2) 30 calendar days from the day following the day on which the contracting entity informed the tenderers that a contract based on a framework contract with reopening of competition or a dynamic purchasing system has been signed, if notification is given a brief explanation of the relevant reasons for the decision. 3) 6 months after the entity has signed a framework agreement – calculated from the day after the day on which the contracting entity informed the tenderers and candidates, cf § 2 (2). 4) 20 calendar days from the day following the day on which the contracting entity has announced the decision according to the Danish law of procurement (No 1564 of 15.12.2015) § 185 (2) second sentence. At the latest at the same time as an appeal is sent to ‘Klagenævnet for Udbud’, the appellant shall in writing inform the contracting entity that the complaint will be sent to ‘Klagenævnet for Udbud’, and whether the complaint is filed during the standstill period referred to in § 3. If the appeal has not been lodged in the stand-still period, the appellant must also state whether it is requested that the appeal is granted delaying effect pursuant to § 12 (1).
