Autre justification: Pursuant to implementing a negotiated procedure without a prior notice, is FOSA § 5-3, letter c. The Norwegian Armed Forces shall enter into a framework agreement with the current supplier, Nordic Safety Systems AB, for the delivery of the helicopter helmets HGU-56/P and Alpha 900. The manufacturer Gentex is the only manufacturer of these helmets and Nordic Safety Systems AB has agencies in Norway. They are thus the only one who can deliver these helmets with additional equipment. A thorough assessment has been made of this, and the main reason why only these helmets can be used is first and foremost the need for interoperability and standardisation of existing and future equipment, as well as safety and security considerations. Furthermore, the contracting authority has not deliberately done anything to adapt the procurement documents to one tenderer. Even if there are equivalent products or services in the market that can cover the contracting authority ́s technical needs, it may lead to the replacement of the entire equipment that is not proportional and contrary to the general procurement regulations.
