The subject of the contract is to provide the service to the contracting authority (1) to carry out on-the-spot checks by the FOTO method selected by the contracting authority on agricultural holdings (2) to carry out on-the-spot checks by means of the field inspection method selected by the contracting authority on agricultural holdings (3) carrying out checks on crop diversification (4) carried out with regard to the maintenance by the farmer of an ecological focus (EFA) scheme (5) drawing up reports from on-the-spot checks with the required inspection documentation for individual farms selected for inspection (6) to receive the audit documentation by the Contracting Authority in accordance with the time limits set out in the contract. On-the-spot checks will be carried out in accordance with the “Instructions for the implementation of checks relating to the eligibility of areas”, which is attached as Annex 2 to the model contracts in annexes 9 and 10 to the Specifications of the relevant contracts.

The subject of the contract shall be the performance by the Contractor of services consisting of: (1) on-the-spot checks carried out on the Fto method, selected by the Contracting Authority for agricultural holdings, located at the on-the-spot control of the entire country, (2) carried out checks on crop diversification in the case of parts of the holdings referred to in point (1). These checks should be carried out within the deadline laid down by the Regulation of the Minister for Agriculture and Rural Development on the calculation period for the shares of different crops in order to diversify crops, (3) carry out checks on the maintenance by the farmer of the ecological features (so-called “EFA”). (b) the Contracting Authority will consider that the Contractor complies with the condition of participation to the extent indicated, if the Contractor can demonstrate that he has the means to carry out field surveys in accordance with the requirements of field measurements of field III of the group, in accordance with the Regulation of the Minister for the Interior and Administration of 9.11.2011 on technical standards for surveying the situation and elevation, and for producing and communicating the results of these measurements to the national geodetic and cartographic resource (Journal of Laws of 2011, No 263, item 1572) or a number of GNSS receivers not less than those specified in the terms of reference in Table 4, as appropriate, for each lot. For Contractors applying for the award of a contract:

(1) the absence of grounds for exclusion referred to in point. 1.1 must meet each individual Contractor,

(2) the conditions for participation in the procedure laid down in point. 1.2 must be met by one or more Contractors. From the procurement procedure, the contracting authority will exclude the Contractor: pursuant to Article 24 ( Articles 1 (12) to (23) of the Act, pursuant to Article 24 (1). 5 of the Act.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

A. Content of the tenders: 1 The tender must be made invalid in electronic form and signed by persons authorised to act in the name and on behalf of the Contractor, with a qualified electronic signature. The Contractor shall submit the tender via the Tender Platform via the Tender Form (Annex 1A in the case of the offers for checks by Fto, Annex 1B in the case of the offers for controls by IT) via the purchase platform. 2 The Contractor shall submit the following documents to the tender: 2.1 Power of attorney to sign the tender, otherwise invalid in electronic form, bearing the qualified electronic signature of the person (s) authorised to be represented in the relevant registry, if the tender has not been signed by the persons authorised to do so. The contracting authority shall allow the electronic submission of a copy of the mandate certified by a notary. 2.2 Proof that a tender guarantee shall be lodged, the original guarantee/surety if the Contractor lodges a deposit in a form other than money bearing the qualified electronic signature of the persons authorised to issue it (document issuers). Where a deposit is lodged in a form other than money, it should be valid for the entire duration of the tender. 2.3 An undertaking by a third party or any other document proving that the Contractor will have the necessary resources to the extent that it is sufficient for the performance of the contract to be discharged if the Contractor relies on the resources of the other entities. The obligation must be set out in an electronic format, which must be signed by a qualified electronic signature of the authorised representative in the relevant register. Chapter IV.5 of the terms of reference shall apply mutatis mutandis. 2.4 The actual date at the date of submission of the declaration in the form of the European Single Procurement Document (hereinafter: “ONE”) drawn up using the model standard form set out in the European Commission Implementing Regulation issued on the basis of Article 59 (1). 2 Directive 2014/24/EU of the European Parliament and of the Council of 26.2.2014 on public procurement and repealing Directive 2004/18/EC. Single document — failing which, in electronic form, endorsed with a qualified electronic signature.

B. Declaration in the form of the Single European Procurement Document.

1 The Contractor shall complete ONE by using the electronic document. The contractor may use the ESPD tool or other tools or software available to fill in ONE and the creation of an electronic document. The contracting authority shall make the file available to the Contractors by means of a xml format which is attached as Annex 12 to the SIWZ. The Contracting Authority states that: http://espd.uzp.gov.pl The Public Procurement Office has made a tool available to enable procurers and economic operators to set up, complete and re-use a standard form for single (single) electronic version (eESPD).

Minimum level(s) of standards possibly required:

2 The statements of the parties submitting the tender jointly and the entities making available for the sole purpose of making available on the JEDE form must be in the form of an electronic document signed with a qualified electronic signature by each of those entities, to the extent that it confirms the circumstances referred to in Article 22 (1). 1 of the Act.

3 An electronic communication tool serving ONE by the Contractor is a buying platform.

4 Electronic document ONLY is recommended in.pdf format).

5 The obligation to produce ONE in an electronic form bearing a qualified electronic signature in the manner set out above also covers ONE’s request pursuant to Article 26 (1). 3 of the Act; For Contractors applying for the award of a contract, the declaration referred to in Rozdz. IV.1. pt. 2.4. SIWZ shall submit to each of the contractors competing for the contract. These documents confirm that the conditions for participation in the procedure are met and that there are no grounds for exclusion to the extent that each of the contractors meets the conditions for participating in the proceedings and that there are no grounds for exclusion.

6 An economic operator who refers to the resources of other entities to demonstrate the absence of grounds for exclusion and to satisfy themselves, to the extent that they rely on their resources, to take part in the procedure shall also submit a statement issued by ONE or more. IV.1. pt. 2.4. SIWZ concerning these entities.

Certificates and documents proving the fulfilment of the conditions of participation in the proceedings and the absence of grounds for exclusion.

When making a statement, the Contractor may provide evidence that the relationship with the other Contractor does not lead to a distortion of competition in the procurement procedure. A model declaration is attached as Annex 3 to the terms of reference.

2 Before awarding the contract, the contracting authority shall invite the Contractor, who has been offered the maximum assessment, to submit, through the purchase platform, within a prescribed period of not less than 10 days, the date at which the declarations or documents signed by the qualified qualified electronic signature have been submitted by the persons authorised to do so in the following terms:

2.1. the absence of grounds for the exclusion of the Contractor from a procurement procedure:

2.1.1. information from the National Criminal Register pursuant to Article 24 (1). 1 points 13, 14 and 21 of the Act and, as regards the conviction for a prison sentence, to the extent determined by the contracting authority pursuant to Article 24 (1). 5 points 5 and 6 of the Act, issued no earlier than 6 months before the closing date for submission of tenders,

2.1.2. a certificate of the head of the tax office, certifying that the Contractor does not have the cost of paying the taxes, issued not more than 3 months before the closing date for the submission of tenders, or any other document proving that the Contractor has concluded an agreement with the competent tax authority concerning the repayment of these charges, including any interest or fines, has been granted, in particular, by means of an exemption, the postponement or the suspension in instalments of late payment or the full implementation of the decision of the competent authority,

III.1.3)Technical and professional ability
List and brief description of selection criteria:

2.1.3. a certificate from the relevant regional organisational unit of the Social Insurance Institution (ZUS) or the Agricultural Social Insurance Fund (Social Insurance Fund) or any other document confirming that the Contractor is unable to pay social or health insurance contributions, issued not more than 3 months before the closing date for the submission of tenders, or any other document proving that the Contractor has concluded an agreement with the competent authority for the payment of these amounts, including any interest or fines, has been granted, in particular, the right to be granted an exemption, a postponement or a suspension in instalments of late payment or the full implementation of the decision of the competent authority,

2.1.4. the extract from the relevant register or the central register and information on economic activities, if separate provisions are required to be entered in the register or in the register, for the purpose of confirming the absence of grounds for exclusion pursuant to Article 24 (1). Article 5 (1) of the Act,

2.1.5. a statement by the Contractor that, in the absence of such a final judgment, a final court judgment or a final administrative decision on arrears of taxes, levies or social or health insurance contributions, or, if such a judgment or decision is taken, documents confirming payment of these claims, including any interest or fines, or the conclusion of a binding agreement on the repayment of these charges,

2.1.6. a statement by the Contractor that there is no decision against him as a preventive measure to prohibit public procurement,

2.1.7. the Contractor’s statement not to pay the local taxes and charges referred to in the Act of 12 January 1991 on taxes and local payments (Dz. Journal of Laws 2018, item 1445 as amended),

2.1.8. a statement by the Contractor that there is no final court judgment against the Contractor for an offence against the limitation of liberty or a fine as referred to in Article 24 (1). 5 points 5 and 6 of the Law,

2.1.9. a statement by the Contractor that there is no final administrative decision in respect of him/her of a breach of his obligations under employment, environmental law or social security legislation within the scope specified in Article 24 (1). 5 point 7 of the Act.

2.2. proof of eligibility for professional and technical capacity:

2.2.1. the list of services carried out and, in the case of periodic or continuous services also carried out, during the last 3 years before the closing date for the submission of tenders and, where the period of the operation is shorter, during that period, and the value, the object, the dates of operation and the entities to which the services have been provided, and a combination of evidence as to whether these services have been performed or are performed, duly substantiated, such as references or other documents issued by the operator to whom the services were provided and, in the case of temporary or continuous services, and if, for justified reasons of objective nature, the Contractor is unable to obtain those documents — a statement from the Contractor; in the case of interim or continuous benefits, references or other documents still to be performed are to be issued no earlier than 3 months before the closing date for submission of tenders. A model declaration is attached as Annex 4 to the terms of reference. Where the Contractor has accompanied any evidence relating to services already carried out (completed), those documents should be issued at the date of completion of the service to which the documents relate;

2.2.2 a list of persons assigned by the Contractor to perform the public contract, in particular those responsible for the supply of services, including information on their professional qualifications, powers, experience and training required for performing the public contract, the scope of their activities and information on the basis of their disposal. 2.2.3. a list of the tools (equipment) available to the Contractor for the performance of a public contract, together with information on the basis of the use of such resources. A model declaration is attached as Annex 6 to the SIWZ;

The lists referred to in points 2.2.2 to 2.2.3 above should additionally be provided in an electronic (editable) form, in MS EXCEL or CSV format (divided by diameters), in one file (one table, whose columns and names should follow the template in Annexes 5 and 6 to the SIWZ, with the proviso that the name and surname be in a separate column:

The scope of information contained in files in an electronic (editable) version should be the same as in Annexes 5 and 6, where the contracting authority informs that the content of the annexes with a qualified electronic signature is binding.

2.3. a statement of the GNSS receiver (Model of declaration is attached as Annex 7 to the SIGZ) [if applicable to the Contractor]

3 The Contractor established in the Republic of Poland, as regards a person resident outside the territory of the Republic of Poland covered by the document referred to in point 2.1.1 of Chapter IV.3 of the SIWZ, shall submit to the Purchase Platform signed by a qualified electronic signature by the persons authorised to do so by the persons authorised to do so, the document referred to in Chapter IV.4, point 1.1 of the SIWZ, within the limits specified in Article 24 (1). 1 points 14 and 21 and para. 5 point 6 of the Act. Where there is no such document in the country in which the person whose document is sought is domiciled, it shall be replaced by a document containing the statement of the person concerned before a notary or before a judicial, administrative or self-regulatory body of that person’s place of residence. The provisions of Chapter IV.4 point 2 of the terms of reference shall apply.

4 If the content of the information supplied by the Contractor in ONLY corresponds to the extent of the information requested by the contracting authority by requesting documents, in particular as referred to in point 2.2, the Contracting Authority reserves the right not to require these documents from the Contractor. In this case, proof of the Contractor’s compliance with the conditions for participation in the procedure and the absence of grounds for exclusion shall be that provided by the Contractor or by the entities in whose capacity or context the Contractor is liable to rely in accordance with Article 22a of the Act.

Should the Contractor be established or resident outside Poland, he shall submit the documents referred to in point C (above) instead of the documents referred to in point C (above). The terms and conditions of the Contractor’s use of his capacity or other capacity shall be set out in Chapter IV.5 of the terms and conditions.

Refers to the timing of the contract: The contracting authority shall require the 1. in the process of carrying out controls using the PHOTO method: (a) the completion of the field work as regards verification of crop diversification requirements for holdings selected for checks on the fulfilment of the diversification conditions was completed within the deadline laid down in the Regulation of the Minister for Agriculture and Rural Development of 6 March 2015 on the calculation period for the participation of different crops for crop diversification. Whereas the amendment of the provisions of that Regulation resulting in the postponement or extension of the period for calculating the shares of different crops for the purpose of crop diversification should be adopted as the operative event without the need for any contract to be accompanied by an inspection; (b) the site has been completed within 35 working days, without prejudice to Section 3 (1). 5 point 4 of the model contract attached as Annex 9 to the SIWZ; (c) the assignment of the return packages from the area concerned shall be made within 50 working days, without prejudice to Section 3 (1). 5 point 6 of the model contract attached as Annex 9 to the SIWZ. 2. in the implementation of checks by Field Inspection by: a) the delivery of the feedback packages from the region concerned takes place within the time limit indicated in the offer form, or up to 35 working days [depending on whether the Contractor undertakes to deliver the return packages within a shorter period of time].

Precise information on deadline(s) for review procedures:

1 Economic operators who have or have had a interest in obtaining a contract and who have suffered or are likely to suffer damage as a result of the Contracting Authority’s failure to comply with the provisions of the Act shall be entitled to the legal remedies specified in Section VI of the Act.

2 An appeal shall lie exclusively with the acts of the Contracting Entity in the award procedure or the failure to act which the Contracting Party is required to act on the basis of the Act.

3 The appeal should indicate the act or omission of the contracting authority alleged to be in breach of the Act, include a brief statement of objections, state the request and indicate the facts and points of fact on which the appeal is based.

4 An appeal shall be lodged with the President of the National Chamber of Appeal on paper or in electronic form, signed or qualified by electronic signature, as appropriate.

5 The appellant shall send a copy of the appeal to the Contracting Authority before the expiry of the time limit for lodging an appeal in such a way that it can be consulted before the expiry of that period. The Contracting Authority shall be deemed to have been able to acquaint itself with the content of the appeal before the time limit for filing it has expired, if it has been sent by electronic means before the time limit has expired.

6 The notice of appeal shall be filed within the following time limits:

(1) 10 (ten) days from the date on which the information on the contracting authority’s action was sent, if sent by electronic means, or within 15 (fifteen) days, if sent by other means;

(2) 10 (ten) days from the date of publication of the notice in the Official Journal of the European Union or the inclusion of the tender in the Internet, as against 3 notices and the terms of the terms of reference;

(3) 10 (ten) days from the date on which, in the case of operations other than those referred to in points (1) and (2) above, the facts on which it was due were due to exercise due diligence.

7 In the event of an appeal against the contract notice or the terms thereof, the Contracting Authority may extend the time limit for the submission of tenders.

8 In the event of an appeal being lodged after the expiry of the time limit for the submission of tenders, the time-limit for submitting the tender shall be suspended until the judgment of the National Board of Appeal has been published.
