II.2.4)Description of the procurement:

As part of the fight against the current Covid-19 pandemic, the European Commission plans to introduce an EU-wide recognised digital vaccination/collection certificate for detection of COVID-19 vaccination and recovery. In Germany, technical implementation is planned even before the entry into force of the EU legal act. The Federal Republic of Germany, represented by the Federal Ministry of Health (‘the contracting authority’), has commissioned a consortium led by IBM Deutschland GmbH to set up a system complying with the planned EU requirements for the provision of digital vaccination certificates and congenital certificates for the healthcare sector in Germany (hereinafter jointly referred to as ‘COVID-19 certificates’). The technical solution sought by the contracting authority provides that patients’ data on COVID-19 vaccinations and recoveries that have been carried out are entered into the electronic practice management systems (‘PVS’) used by local doctors’ practices in a well-established way and that a COVID-19 certificate is created through a module via an interface via the COVID-19 certificate system under development. This should make it possible to provide patients with a COVID-19 certificate from the usual PVS environment.

The development and implementation of the digital interfaces between the different PVS on the market and the COVID-19 certificate system as soon as possible, as well as subsequent IT support services, are the subject of the present authorisation procedure (also referred to as ‘open house procedures’). In doing so, the contracting authority calls on a generally unrestricted number of interested undertakings (‘tenderers’) to submit tenders for the conclusion of a ‘contract for the creation of a certificate module for primary systems for the issuance of COVID-19 certificates’ (hereinafter referred to as ‘Contract7’). In principle, the contracting authority will conclude a contract with each tenderer who has submitted a tender in accordance with the conditions for participation in the admission procedure (‘TbZ’) and annexes (hereinafter jointly referred to as ‘the procedural documents’) and who provides the required qualifications.

As the number of tenderers that can be awarded a contract is not limited and the contracting authority does not select different tenders/companies (contrary to what is stated in point II.2.5) no award criteria exist), the present authorisation procedure is not a procurement procedure within the meaning of Directive 2014/24/EU and § § 97 et seq. GWB, so that the rules on procurement procedures do not apply.

On the other hand, the authorisation procedure is based on the principles developed by the European Court of Justice on the open house procedure.

The sole purpose of this notice is to ensure that the authorisation procedure is as transparent as possible. In the absence of a corresponding publication form, the contract notice form shall be used. It does not have the effect, nor is it intended, to define a particular type of normal procurement procedure. In so far as, in the context of this notice, certain concepts from competition law (such as ‘open procedure’)

They are used only for compelling technical reasons in the electronic supplement form to the Official Journal of the European Union.

The dates and time limits set out in this notice have also been entered for compelling technical reasons and (with the exception of the deadline for submission of tenders) should not be valid in the current approval procedure.

The exact duration of the contract at issue in these proceedings (see point II.2.7) depends on the date of accession to the admission procedure and conclusion of the contract.
