As the number of tenderers that can be awarded a contract is not limited and the contracting authority does not select different tenders/companies (contrary to what is stated in point II.2.5) no award criteria exist), the present authorisation procedure is not a procurement procedure within the meaning of Directive 2014/24/EU and § § 97 et seq. GWB, so that the rules on procurement procedures do not apply.
On the other hand, the authorisation procedure is based on the principles developed by the European Court of Justice on the open house procedure.
The sole purpose of this notice is to ensure that the authorisation procedure is as transparent as possible. In the absence of a corresponding publication form, the contract notice form shall be used. It does not have the effect, nor is it intended, to define a particular type of normal procurement procedure. In so far as, in the context of this notice, certain concepts from competition law (such as ‘open procedure’)
They are used only for compelling technical reasons in the electronic supplement form to the Official Journal of the European Union.
The dates and time limits set out in this notice have also been entered for compelling technical reasons and (with the exception of the deadline for submission of tenders) should not be valid in the current approval procedure.
Contrary to what is stated in section I.3), the submission of the tender must be sent by e-mail to: impfzertifikat-PVS@pd-g.de to be carried out.
The exact duration of the contract at issue in these proceedings (see point II.2.7) depends on the date of accession to the admission procedure and conclusion of the contract. The duration of the contract shall start with the acceptance of the tenderer’s bid by the contracting authority and shall expire on 30 June 2022.
