Justification for a framework agreement the duration of which exceeds 4 years: the duration of the framework agreement shall encompass the planning, construction and commissioning of the new building.
II.1.5)Short description of the contract or purchase(s):
The objective of the assignment (the ‘assignment’) is to assist EIB internal audit (IA) in the provision of independent assessment/audit services during the planning, construction and acceptance/handover of the EIB new building project (‘BTF project’). The envisaged audits (services) cover:
— design planning and permit application,
— procurement plan, including the invitation to tender documents for general contractors,
— periodic invoice checking,
— periodic progress reporting (time/money/organisation),
— periodic recommendations follow-up,
— testing and commissioning concept.
And in 2019, the flexibility to have the scope of 1 audit is still to be defined.
NB: in order to take part in this call for tender, interested candidates should request the complete tender specifications from the EIB beforehand. The criteria set out in the specifications should be taken into account when drawing up tenders.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers:
Information and formalities necessary for evaluating if requirements are met:
The tenderers should declare whether they are providing and/or have provided services to the EIB in the past. In the event of an affirmative answer, they will be asked to provide information with respect to the nature of these services, the time interval when they were provided and the value of the previous contracts. The EIB will assess whether a conflict of interest exists and will decide to either exclude the tenderer from the award of this framework agreement or take other kinds of measures to guarantee the independent nature of the critical assessment/audit.
The tenderers shall provide a declaration on their honour (see Annex 5a), duly signed and dated by an authorised representative, stating that they are not in one of the situations of exclusion listed in Annex 5a. In the case of a joint tender, the declaration on the honour shall be provided by all members of the group. The successful tenderer shall provide the documents mentioned as supporting evidence in Annex 5a before signature of the contract and within a deadline given by the EIB. The successful tenderer shall provide the following evidence upon request and within the time limit set by the EIB.
For situations described in (a), (b) and (e) of Annex 5a, production of a recent extract from the judicial record is required or, failing that, a recent equivalent document issued by a judicial or administrative authority in the country of origin or provenance showing that those requirements are satisfied. Where the tenderer is a legal person and the national legislation of the country in which the tenderer is established does not allow the provision of such documents for legal persons, the documents should be provided for natural persons, such as the company directors or any person with powers of representation, decision-making or control in relation to the tenderer.
For the situation described in point (d) of Annex 5a, recent certificates or letters issued by the competent authorities of the State concerned are required. These documents must provide evidence covering all taxes and social security contributions for which the tenderer is liable, including for example, VAT, income tax (natural persons only), company tax (legal persons only) and social security contributions.
For any of the situations (a), (b), (d) or (e) of Annex 5a, where any document described in the 2 paragraphs above is not issued in the country concerned, it may be replaced by a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in his country of origin or provenance.

Tenderers should satisfy the following requirement in order to be selected: minimum annual overall turnover during the last 3 financial years: 1 500 000 EUR yearly in the required field, i.e. critical assessment/audit of building construction projects.

Tenderers must have 3 references of previous critical assessments/audits of building construction concerning project management and/or audit/assessment of office buildings > 40 000 m2 and/or of audit/assessment of a building which cost > 100 000 000 EUR.

Proof of the above is to be provided by:
Descriptions (including the contact details of the client) of previous services on office buildings and/or commercial buildings: the tenderer should provide a maximum of 3 descriptions of projects completed in the last 5 years or projects which are under way in project management and/or audit/assessment of an office building and/or a commercial building.
Of these 3, 2 shall meet either 1 or several of the below listed criteria:

— floorspace of a single or set of office buildings (on the same plot) above 40 000 m2,

— cost of a single or set of commercial and/or public and/or office buildings above 100 000 000 EUR.
Of these 3, 1 shall meet either 1 or several of the below listed criteria:

— floorspace of a single or set of office buildings (on the same plot) above 40 000 m2,

— a building tower of 15 floors or more,
— a nearly zero-energy office building,
— cost of a single or set of commercial and/or public and/or office buildings above 100 000 000 EUR.
b) Availability of staff members per profile:
Requirement:
The availability of a team in the range of services concerned and related to the specific scenarios described in Appendix I, including knowledge and ability to apply relevant international standards in the areas of expertise, which should include the following profiles:
— team/project leader — with at least 15 years of relevant experience and should demonstrate programme management skills and an ability to manage a team; significant project management experience in the EU is required,
— senior experts in the relevant fields described in Annex I — with at least 12 years of relevant experience; substantial experience in and knowledge of current best practice in procurement, tendering and contract management; experience in leading mid-term and/or ‘ex post’ evaluation of projects,
— experts in the relevant fields described in Appendix I — with at least 8 years of relevant experience,
— support team members.
The team members, with the exception of the support team members, should have complementary expertise: they should be graduates in engineering, architecture, surveying, economics/finance or equivalent educational background with at least a master's degree.
Proof of the above is to be provided by:
The tenderer shall give details on degrees, specialisation and experience of the available profiles, using the profile template in Appendix III.
An undertaking that all team members appointed to the performance of the services shall have proficiency in English and at least 1 team member shall have a good knowledge of French.
An undertaking that all team members appointed to the performance of the services shall have at least 8 years of experience in the relevant fields.
