The contract will be carried out in the framework of the tasks resulting from the Act of 28 March 2003 establishing a multiannual programme “a programme for the protection of the sea banks”. The monitoring shall be carried out to assess the state of the sea shore by analysing the composition of the seabed and all elements of the coastal zone, whether natural or artificial, which have an impact on the maintenance of the sea coast.

II.2.4)Description of the procurement:

1. The subject of the contract is the performance of sea banks monitoring on the basis of aeronautical data obtained by laser LIDAR, the orthophoto map and the transverse profiles of the sea shore. The contract will be carried out in the framework of the tasks resulting from the Act of 28 March 2003 establishing a multiannual programme “a programme for the protection of the sea banks”. The monitoring shall be carried out to assess the state of the sea shore by analysing the composition of the seabed and all elements of the coastal zone, whether natural or artificial, which have an impact on the maintenance of the sea coast for the following sea banks:

1.1th coast of the coast within the territorial scope of the Director of Gdynia Maritime Office covering the sea border from the border of the State with the Russian Federation (km 0,0) to the administrative border of the Maritime Office in Gdynia in the West (km 243,9), as well as the maritime sea of the Łódź Mierzi Sea (kmh 0,0-71,5) — a total of 315.4 km of coasts of the coast, 633 transverse profiles;

1.2th coastlines of the Vistula Lagoon — 102.1 km of the Vistula Lagoon, 205 transverse profiles;

1.3th port areas — 5 433 ha.

2. Within the subject-matter of the contract, the following tasks shall be carried out:

2.1th activity No 1 — monitoring of coasts of the coast and of the Vistula Lagoon and of port areas in 2021;

2.2th activity No 2 — monitoring of coasts of the coast and of port areas in 2022;

2.3th activity No 3 — monitoring of coasts of the coast and of port areas in 2023.

3. The Contractor will provide the Contracting Party with a defect in the design (for each task on a case-by-case basis) for a period of 24 months.

4. A detailed description of the subject of the contract, including the scope and the manner of preparing and setting up the project, is set out in Annex 12 to the SIWZ — Description of the subject of the contract (OPZ).

5. The Contractor must perform the contract in accordance with the terms and conditions described in the model contract attached as Annex No 3 to the SIWZ.

6. In carrying out the contract, the contracting authority reserves the right to limit the scope of the contract to 20 % of the value of the contract for each task.

7. Pursuant to Article 29 ( 3a of the Public Procurement Act, the contracting authority shall require the Contractor and subcontractors of employment to contract persons who carry out activities related to the implementation of the subject matter of the contract, persons implementing the photogrammetric site, in so far as they fall within the scope of Article 22 (1) of the Labour Code, which provides: ‘A worker undertakes to carry out work of a particular type, for and under the direction of an employer, and at the place and time set by the employer and the employer, to hire a worker for remuneration.’

8. The method of recording the person’s employment, the contracting authority’s power to verify compliance by the Contractor with the above requirements and the penalties for failure to meet those requirements is laid down in Annex No 3 to the SIWZ — the model contract.

1.3th activity No 3 — monitoring of coasts of the coast and of port areas in 2023 until 31 August 2023.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

The conditions for participation concerning economic or financial standing shall be deemed to be met if the Contractor proves that he is insured against civil liability in respect of his activities relating to the subject matter of the contract for a guarantee sum of not less than PLN 500 000,00 (in words: five hundred thousand zloty 00/100). Note! Where contractors show the values necessary to assess whether the conditions for taking part in the proceedings in currencies other than PLN are met, the contracting authority, as the conversion rate of currency, will take the average rate of the currency concerned to be published by the National Bank of Poland on the date of publication of the contract notice. If, on the date of publication of the contract notice, the National Bank of Poland does not publish the average rate of the currency in question, the average rate shall be used as the basis for conversion, on the first day after publication of the contract notice.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

1. Conditions for participation relating to technical or professional ability — condition will be considered to be met if the Contractor:

He carried out his work during the last five years before the closing date for the submission of tenders and, if

the period of operation is the shorter of the minimum of two services which it covers.

the scope of the orthophotomap with laser scanning LIDAR, which covered

at least:

1) the execution of colour digital aerial photographs of RGB with the development of a orthoometric image based on them with a pixel resolution of at least 20 cm for an object with an area of not less than 100 km.2,

2) LIDAR scanning operation with a density of not less than 6 points m2 together with the development of data from laser scanning and their processing into a raster format;

He/she has carried out during the last five years before the closing date for the submission of tenders and, if

the activities are shorter during this period a minimum of two services, which included within their scope measurements of bathymetric shore profiles with echo sounders, including the development of results, with the sum of the profiles of the profiles developed of not less than 100 km;

1.3. will refer to the subject matter of the contract the following persons:

(1) at least one person with experience in at least one service covering at least:

the design of photogrammetrical, post-processing GPS/INS data, and,

(b) performance of the digital service, photogrammetrical aerial photographs, where the service must relate to digital performance, photogrammetrical aerial photographs with a resolution of not more than 20 cm for an object with an area of not less than 100 km2;

2) at least one person with professional qualifications in geodesy and cartography in accordance with Article 43 (1) of the Geodetic and Cartographic Law Act (i.e. Journal of Laws 2020, item (276 as amended), (3) at least one person holding the category ‘A’ category ‘A’ seniority, attested by a diploma, of hydrograph category A, to carry out hydrographical measurements in Polish marine areas in accordance with Article 41e (3). 2 of the Act of 21 March 1991 on the maritime areas of the Republic of Poland and the Maritime Administration (Journal of Laws 2019, item 2169 as amended);

1.4. the purpose of the contract will be to:

(1) by plane or helicopter equipped with:

a) stabilised camera support for the camera and the LIDAR scanner with the floor of the aeroplane or helicopter,

flight planning and management system,

(c) the measurement of the digital camera;

(2) at least 1 digits in the digital camera:

(a) produced and intended for the performance of photogrammetrical aerial photographs,

fitted with integrated GPS and INS systems for the measurement of x-coordinates, y, z and angles ω, φ, κ that define the position of the camera at the time of exposure,

c) designed and connected to a GPS system capable of recording the moment of exposure with a resolution of no less than 1 millisecond,

(D) fitted with an image offset system for the progressive operation of an aeroplane,

(e) with a resolution of not less than 100 megapixels;

3) at least 1 digital LIDAR digital scanner:

a) produced and intended for the performance of photogrammetrical aerial photographs,

b) fitted with integrated GPS and INS systems for the measurement of x-coordinates, y, z and angles ω, φ, κ that define the position of the camera at the time of exposure,

c) designed and connected to a GPS system capable of recording the moment of exposure with a resolution of no less than 1 millisecond,

(D) recording at least four reflections of a single pulse,

recording intensity of reflection;

(4) at least 1 measurement unit, equipped with a hydrography ECHO sounder or a multi-sheet hydrography;

5) at least 1 GNSS geodetic receiver to perform RTK measurements.

1. A tendering security shall be required for the amount of: PLN 50 000,00 (in words: PLN 50 000).

2. The contracting authority shall state that it provides for the possibility of awarding contracts in accordance with the procedure laid down in Article 67 (1). 1 point 6 of the Public Procurement Act, in the form of direct agreement contracts consisting of the repetition of similar services up to a value of not more than PLN 915 050,63 net.

2.2. The contracts will be awarded by (during the summer season):

2.2.1. a scan of the laser peninsula and obtaining an orthophoto map;

2.2.2. airport scanning and obtaining orthophoto maps;

2.2.3. measuring bathymetric features of marine coastal protection sites.

3. Conditions for the award of the contract:

3.1. performance in whole or in part, in accordance with the contract;

3.2. deliver a standard of services not worse than basic services;

3.3. maintenance of the essential conditions of the basic contract, provided that the scope of the services, the time limit and the price will be negotiated by direct agreement;

3.4 award at the latest within a period of 3 years from the date on which the contract was awarded.

4. The contracting authority will make use of the provisions of paragraph 1. 24aa of the Public Procurement Act and the reverse procedure.

5. The contracting authority shall exclude from participation in the procedure the Contractor referred to in Article 24 (1). 5 point 1 of the Public Procurement Act.

6. Within 3 days from the date on which the contracting authority enters into the information from the opening of the tenders referred to in Article 86 (1) on its website and on its platform. 5 of the Public Procurement Act, the Contractor is required to provide the Contracting Authority with a declaration of whether or not it is part of the same group as referred to in Article 24 (1). 1 point 23 of the Public Procurement Act.

7. In order to confirm that the conditions for participation in proceedings concerning technical or professional ability have been satisfied, the Contractor shall, at the request of the Contracting Authority, submit the following documents and declarations:

7. 1. a document confirming that the Contractor is insured against civil liability in respect of the activities related to the subject-matter of the contract for the guarantee sum specified by the Contracting Authority in point 6.2.2 of the SIWZ;

VI.4.3)Review procedure
Precise information on deadline(s) for review procedures:

1. Any contractor and any other body if he or she has or has had an interest in obtaining a particular contract and who has been or may be harmed by an infringement by the Contracting Authority of the provisions of the Public Procurement Act shall be entitled to the remedies provided for in section VI of the Public Procurement Act as for proceedings above the amount specified in the implementing provisions issued pursuant to Article 11 (1). 8 of the Public Procurement Act. 2. Legal remedies against a contract notice and SIWZ shall also be available to organisations included in the list referred to in Article 154 (5) of the Public Procurement Act.

2. Precise information on the time limits for appeals is contained in Chapter 22 of the SIWZ.

3. The appeal shall be lodged within the time-limits laid down in Article 182 of the Public Procurement Act:

3.1. The appeal shall be lodged within 10 days of the date on which the contracting authority is informed of the act on which the appeal is based, if it is sent as referred to in Article 180 (1). The second sentence of section 5 of the Public Procurement Act, or within 15 days if they have been sent by other means.

3.2. An appeal to the content of a contract notice as well as to the provisions of the Tender Specifications shall be lodged within 10 days from the date of publication of the notice in the Official Journal of the European Union or listing the material terms of the contract on the website.

3.3. An appeal against acts other than those referred to in points 22.6.1 to 22.6.2 of the SIWZ shall be lodged within 10 days of the date on which the due date of commencement or due diligence is exercised.

3.4. If the contracting authority has not sent the Contractor a notice of choice, the appeal shall be lodged no later than the following date:

30 days after the date of publication in the Official Journal of the European Union of the contract award notice;

(b) 6 months from the day of the conclusion of the contract if the contracting authority did not publish the contract award notice in the Official Journal of the European Union.
