The subject of the contract will be carried out in the following stages, hereinafter referred to as ‘steps’:

II.2.4)Description of the procurement:

The subject of the contract is the construction of the IT system “Spatial Statistics in the Country Information System” (PDS) and the implementation of the training activities of the PDS project.

The subject of the contract will be carried out in the following stages, hereinafter referred to as ‘steps’:

Phase 1 — Part 1 — development of a new functionality of the PDS system, including the following tasks, hereinafter referred to as ‘tasks’:

1) Task 1 — design of the PDS project plan and analytical documentation;

2) Task 2 — development of the PDS design documentation;

3) Activity 3 — supply, installation and configuration of hardware and tool infrastructure components of the PDS system, including:

the supply, installation and configuration of necessary hardware and tool infrastructure components for the PDS system;

the development of as-built documentation for equipment and tool infrastructure;

(4) Task 4a — developing and putting in place a new functionality for the PDS system in the field of US-01 services (access service for computer equipment to the output of statistical information collected on the Portal with the possibility of advanced spatial analysis and access to data and metadata for spatial information infrastructure) and US-02 (access service from mobile devices to the resulting statistical information collected on the portal and to the visualisation of the information on the maps), including:

(a) the production and supply of dedicated software for US-01 and US-02 services;

(b) the documentation of the testing of US-01 and US-02 services;

(c) the provision of test data for the services US-01 and US-02;

installation, configuration and launch of dedicated software and performance testing of US-01 and US-02 services;

(e) the development of test reports for services US-01 and US-02;

(f) the development of as-built documentation for US-01 and US-02 services;

2nd phase 1 — part 2 — Task 4b — creating a new functionality for the PDS system in the field of US-03 services (service that allows the use of an exploratory spatial data analysis made available by the gateway), US-04 (service to perform analyses of the geo-statistical modelling), US-05 (service supporting the user’s own information and geo-statistical analysis to be made available by the portal) and US-06 (service to support the updating of selected TERYT registry facilities and associated geo-reference sites), including:

(a) the production and delivery of dedicated software for US-03, US-04, US-05 and US-06 services;

(b) the documentation of the testing of US-03, US-04, US-05 and US-06 services;

(c) the provision of test data for US-03, US-04, US-05 and US-06 services;

install, configure and deploy dedicated software and perform testing activities for US-03, US-04, US-05 and US-06 services;

(e) the development of test reports for services US-03, US-04, US-05 and US-06;

(f) the development of as-built documentation for the services of the PDS system, i.e. services US-01, US-02, US-03, US-04, US-05 and US-06;

Phase 3 2 — preparation and training related to the implementation of the PDS system, including:

a) the development of a workshop plan for the PDS system;

the development of a workshop documentation for the PDS system;

holding workshops for PDS system;

the development of a training report for the PDS system;

Phase 4 3 — Supply of copyright and technical assistance and guarantee and technical assistance services, including:

the provision of copyright surveillance services for the PDS system;

provision of technical assistance services for the PDS system;

the provision of guarantee services for the PDS system;

provision of technical support services for the PDS system.

The contracting authority reserves the right to cancel the proceedings if the appropriations originating from the budget of the European Union that it intended to be used to finance the contract will not be awarded to it.

II.2.14)Additional information

The contract will be concluded by the Contractor within 15 months of the date of conclusion of the contract, but no later than 4.6.2021, whichever is the first, subject to the implementation of the various stages.

The date of execution of the contract is detailed in point 6 of the SIWZ.

Section III: Legal, economic, financial and technical information

The contracting authority will consider the condition to be met if the Contractor demonstrates that he has the credit standing or has the available financial means of at least PLN 500 000,00.

III.1.3)Technical and professional ability
Minimum level(s) of standards possibly required:

Contractors who demonstrate that, during the last 3 years before the closing date for the submission of tenders, and if a shorter business period is shorter during that period, shall be eligible to apply for a contract to the Contractor at least:

(a) 1 order of a value of not less than PLN 10 000 000,00 gross subject to the construction or extension of an electronic system for the design, execution and deployment of an IT system making available the e-services via a web browser for computer and mobile devices using the following type of solution: webmapping, GIS and Open Source software.

(b) 1 order of a value of not less than PLN 2 000 000,00 gross of which the construction or extension of an electronic system covering the delivery, configuration and implementation of the components of equipment infrastructure and the configuration of the virtual processing environment was the subject of the contract.

In addition, contracts may be awarded to the Contractor who has or will have a team of persons capable of performing the contract and meeting the following requirements:

A. coordinator of the contractor’s team — during the last 5 years before the closing date for the submission of tenders, for a continuous period of at least 12 months, served as the steering/coordinating person of the project, i.e. coordinating the work of the whole project team, including the implementation, implementation and operation of an IT system that has GIS solutions (the project has been properly implemented and received by the contracting authority and has been placed in service) and the value of the project was not less than PLN 10 000 000,00 gross;

B. the IT infrastructure architecture architect — in the last 3 years before the closing date for the submission of tenders, has served as an architect of the ICT infrastructure solutions for at least 1 projects using virtual or cloud solutions, making the e-services available via a web browser for computer and mobile devices using the following types of solutions: GIS, business intelligence and Open Source software, with a value of not less than PLN 2 000 000,00 gross;

C. The architect of GIS systems — in the last 3 years before the closing date for the submission of tenders, served as an architect of solutions with software modelling tools in UML, for example an enterprise architect, in at least 1 project, concerning in particular the construction/development of IT systems with GIS solutions, of a value of not less than PLN 5 000 000,00 gross;

D. analyst — within the last 3 years before the closing date for submission of tenders, served as data analytics in at least 1 project for the construction or development of an analytical system, where the project’s scope of work included the integration of data from multiple data sources, the creation of a data repository, the development of data analysis (data mining) and the development of an analysis of structural data (text mining and content categorisation) using UML software modelling tools, such as an enterprise architect, of a value of not less than PLN 5 000 000,00 gross;

E. The ICT security expert, during the last 3 years before the closing date for submission of tenders, has served as an expert and/or security analyst for at least 1 project, setting up security assumptions for the proposed electronic systems, including, in particular, the area of processing and data protection;

F. an app implementation expert — in the last 3 years before the closing date for the submission of tenders, has dealt with the installation, configuration and deployment of ICT systems that have GIS solutions in at least 1 designs, with a value of not less than PLN 1 000 000 gross.

The team will count no less than 4. A combination of roles is allowed outside of koord.

(2) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for receipt of tenders or requests to participate, or any other document proving that the Contractor has concluded an agreement with the competent tax authority on the repayment of those taxes, together with interest or fines, if any, and, in particular, has obtained the authorised exemption, deferral or payment of any outstanding payments or suspension of the execution of the decision of the competent authority in full;

(3) a certificate issued by the relevant territorial unit of the Social Insurance Institution or of the Kasa Rolniczego Ubezpieczenia Społecznego or of Kasa Rolniczego Ubezpieczenia Społecznego (Agricultural Social Insurance Fund) or other document proving that the Contractor is not in default of paying social security contributions or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders or requests to participate, or any other document confirming that the Contractor has concluded an agreement with the competent authority for the repayment of those debts, together with interest or fines, if any, and, in particular, has obtained the lawful dismissal, deferral or payment of any outstanding payments or suspension of the execution of the decision of the competent authority in full;

(4) a copy of the relevant register or of the Central Inventory and Information on Economic Activity where separate provisions require entry in a register or records, in order to confirm the absence of grounds for exclusion on the basis of Article 24 (1). 5 (1) of the Act;

(5) a statement by the Contractor that no decision has been taken against him as a precautionary measure against the requirement to apply for public contracts;

Precise information on deadline(s) for review procedures:

1. In the light of the provisions of the Terms of Reference and the action taken by the Contracting Authority in the course of the proceedings and in the event of failure by the Contracting Authority to act in respect of which he is required to act pursuant to the Act, the Contractor shall be entitled to the remedies provided for in Chapter VI of the Act, i.e. the appeal and the action before the courts.

2. In accordance with Article 180 of the Healthcare Law,

(1) the appeal lies solely against the unlawful act of the contracting authority in the procedure for the award of a contract or the act which the contracting authority is required to carry out pursuant to the Act;

(2) the appeal must indicate the act or omission of the contracting authority alleged to be in non-compliance with the provisions of the law, contain a summary of the pleas in law, set out the request and indicate the circumstances of fact and of law justifying the lodging of the appeal;

(3) the appeal is lodged with the President of the Chamber in writing or in electronic form, signed by a secure electronic signature verified by means of a valid qualified certificate or equivalent measure meeting the requirements for this type of signature;

4) the appellant shall forward a copy of the appeal to the Contracting Authority before the expiry of the time-limit for bringing an appeal in such a way that it can take note of its contents before the expiry of that period. The Contracting Authority shall be deemed to have become aware of the content of the appeal before the expiry of the period for lodging it, if the copy of the appeal was sent before the expiry of the time-limit for bringing the appeal in question by means of electronic communication.

3. In accordance with Article 182 of the Healthcare Law,

(1) the appeal shall be lodged within 10 days of the date on which the contracting authority is informed of the act giving rise to the appeal, if it has been sent in the manner laid down in Article 180 (1). 5 of the Act, the second sentence or within 15 days if they have been sent by other means;

(2) the reference to the text of the contract notice and, if the procedure is conducted by means of an open tendering procedure, including the provisions of the Tender Specifications, shall be lodged within 10 days from the date of publication of the notice in the Official Journal of the European Union or specification of the Terms of Reference on the website;

(3) Appeal against acts other than those referred to in points 1 and 2 must be lodged within 10 days of the date on which, or on the exercise of due diligence, it was possible to know the facts on which the appeal was based.
