The performance guarantee set by the contracting entity shall be 3 % (three per cent) of the value of the contract for the performance of the contract without VAT.

The guarantee shall be furnished in one of the following forms:

1. a sum of money to be paid to the abovementioned account;

2. a bank guarantee;

3. insurance to ensure fulfilment by cover of the contractor’s liability.

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

1 The participant shall hold a valid registration in the Register of tour operators and travel agents under Article 61 of the Tourism Act or shall be a person under Article 62 of the Tourism Act.

The participants shall declare the presence of the minimum eESPD requirement.

The participants demonstrate the minimum requirement by means of a certified copy of a valid document of registration in the Register of tour operators and travel agents under Article 61 of the Tourism Act or being a person under Article 62 of the Tourism Act.

2 The participant should be registered as a data controller by the Data Protection Commission. Foreign legal persons shall apply an equivalent document to the competent authority of the country in which they are established.

In case the tenderer does not hold such a registration, he declares that, in case of classification, he will first register as a data controller before the signature of the contract for performance of the contract.

The participants shall declare the presence of the minimum eESPD requirement.

The Participants shall demonstrate the minimum requirement through a certified copy of the Personal Data Protection Commission registration document. Foreign legal persons shall apply an equivalent document to the competent authority of the country in which they are established.

3 The tenderer shall have the right to issue flight tickets to airlines operating direct flights from or to Bulgaria and presented in Billing Settlement Plan (BSP) or an equivalent international air transport payment system with which the participant is working at the date of submission of tenders.

The participants shall declare the presence of the minimum eESPD requirement.

Participants shall demonstrate the minimum requirement by means of a certified copy of a document (including extract or printout from BSP Link) confirming a valid authorisation from the Billing Settlement Plan Plan (BSP)/BSP Link to airlines flying direct from and to BULGARIA for which the bidder is authorised at the date of submission of bids included in the Billing Settlement Plan (BSP) or equivalent document certifying valid authorisation of the participant in the Billing Settlement Plan (BSP) system; a copy of a valid insurance policy issued by a licensed insurance company against the risk of non-payment through the Billing Settlement Plan or a Minimum Coverage Ratio.

4 The participant shall be a member or accredited agent in the International Air Transport Association (IATA).

The participants shall declare the presence of the minimum eESPD requirement.

Participants shall demonstrate the minimum requirement by means of a certified copy of a document certifying the membership or accreditation of the tenderer to the International Air Transport Association (IATA) for the sale of air tickets.

The contracting authority will accept equivalent documents issued by bodies established in other Member States.

Where there are participants who are foreign persons, they should be entered in a corresponding trade and/or professional register in accordance with the legislation of the Member State in which they are established.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

The participant shall have valid compulsory insurance ‘Tour operator liability’ in accordance with Article 97 of the Tourism Act or equivalent according to the legislation of the State where the applicant or participant is established.

The participants shall declare the presence of the minimum isshots at the eESPD.

The Participants shall demonstrate the minimum requirement with a copy of a valid compulsory insurance ‘Liability of the tour operator’ in accordance with the Law on Tourism, or equivalent, according to the legislation of the country where the applicant or participant is established.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

1 The participant must have executed during the last 3 (three) years from the date specified for the receipt of tenders, services/activities by object and volume similar to the subject matter.

“services similar to the subject matter of the contract” should be understood as services/activities related to tour and/or accommodation services, including the sale of airline tickets and/or hotel accommodation.

The Participants shall declare the existence of the required experience of completed activities of an object and volume identical or similar to the amount of the eESPD due to it.

The Participants shall demonstrate the minimum requirement through a list of the services performed, with an indication of the values, dates and recipients, together with evidence of each service performed.

2 The participant should work with a global system for booking and selling the Amazon flight tickets or another equivalent system for booking and selling air tickets.

The participants shall declare the presence of the minimum eESPD requirement.

Participants shall demonstrate the minimum requirement through certified copies of valid documents, certificates or other certificates attesting a participant’s authorisation to operate a global system for the reservation and sale of air tickets Amadeus or any equivalent global reservation system and the sale of air tickets.

3 The participant shall have in place an information security compliance system in place according to ISO/IEC 27001 or equivalent with the scope of certification identical or similar to the subject matter of the contract.

The participants shall declare the presence of the minimum eESPD requirement.

The Participants shall demonstrate the minimum requirement through a certified copy of a valid information security compliance certificate established in accordance with ISO/IEC 27001 or equivalent with a same certification in scope of certification or equivalent to the subject matter of the contract.

In case of participation of associations which are not legal persons, compliance with the selection criteria shall be proven by the combined participant and not by any of the persons covered by it, with the exception of the registration, presentation of a certificate or other condition necessary for the execution of the contract, as required by a statutory or administrative act and having regard to the allocation of the persons’ participation in the performance of the activities provided for in the contract establishing the consortium.

1 The tenderer must have complied with in the last 3 (three) years from the date indicated as last to receive the tenders, successfully at least 3 (three) services/activities similar to the subject of the contract.

The circumstances referred to in Article 54 (1) and Article 55 (1) and subparagraphs 1 and 2 of Article (referred to in Article 3 (8) and Article 4 of the Act on Economic and Financial Relations with companies registered in preferential tax jurisdictions, persons associated with them and their beneficial owners shall not be available to tenderers. The absence of declared circumstances shall be declared in the eESPD. Participants also submit a declaration of a lack of connection with any other participant under Article 101 (11) of the PPA (model 3).
