III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Requirement 1: tenderers/associations/third parties/subcontractors must not be included in the situations referred to in Articles 164, 165 and 167 of Law No 98/2016.

How to demonstrate that the requirement is met:

(a) The tenderers will fill in in the SICAP, directly, after authentication, with the information related to their situation, the answers to the DUAE published by the contracting authority in the award documentation,

(b) The supporting documents that will prove that they are carried out by completing the DUAE will be submitted, at the request of the contracting authority, only by the bidder ranked first in the intermediate ranking.

These documents are:

— Tax certificate on the absence of outstanding debts relating to the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the time of the submission — scanned in pdf format and electronically signed,

— Tax certificate on the absence of outstanding charges relating to the payment of taxes, local taxes and other revenue of the local budget issued by the town hall (local council) at the time of presentation — scanned in pdf format and electronically signed,

Criminal record of the economic operator and members of the administrative, management or supervisory body of that economic operator or those having powers of representation, decision or control therein, as evidenced by the certificate issued by the NTRO/memorandum of association — scanned in pdf format and electronically signed.

Note: equivalent documents will be produced for foreign bidders issued by the competent authorities of the country of residence — scanned in PDF format and signed electronically.
